Terms and Conditions

These Terms and Conditions govern access to, browsing of and use of the LocalCheck platform, available through the domain localcheck.info, and its PropCheck sub-brand (localcheck.info/propcheck, also accessible from propcheck.es), both owned by KonnektWerk Tech & Entertainment S.L.U., as well as the terms for contracting the services offered through the platform.

Accessing or using LocalCheck implies full acceptance of these terms.

If the user does not agree with them, they must refrain from using the platform.

LocalCheck is a technology platform that provides a preliminary assessment of the urban-planning feasibility of setting up an economic activity at a given property.

PropCheck, within the same platform, is an independent property due-diligence service aimed at anyone buying or investing in homes, land or whole buildings: it brings together urban-planning classification, heritage protection, cadastral reference, affordable-housing/tensioned-market status (where applicable) and area data, all from official sources and without issuing a business verdict.

The platform automatically analyses information from public and official sources to provide an indicative result that helps with initial decision-making.

Neither LocalCheck nor PropCheck represent Barcelona City Council or any Public Administration.

The user expressly accepts that:

• LocalCheck does not grant licences.
• LocalCheck does not authorise activities.
• LocalCheck does not replace a technical project.
• LocalCheck does not issue urban-planning certificates.
• LocalCheck does not provide legal advice.
• LocalCheck does not replace the involvement of architects, engineers or other competent professionals.

The results obtained are for informational purposes only.

The final decision on setting up any activity rests exclusively with the competent Administration.

The same applies to PropCheck: its due-diligence report is not an official land-registry extract, does not prove ownership or encumbrances on the property, and does not replace verification by a notary, land registrar or competent professional before buying or investing.

Creating an account is required to use certain features.

During the registration process, the user must provide truthful, complete and up-to-date information.

The user is responsible for keeping their access credentials confidential.

Any activity carried out from their account will be deemed to have been carried out by the user themselves, unless proven otherwise.

When the user acts on behalf of a company, they may provide, among other details:

• legal name;
• tax ID (CIF/NIF);
• address;
• phone number;
• email;
• contact person.

The user guarantees that they have sufficient authority to act on behalf of that entity.

LocalCheck may offer:

• a free tier;
• paid tiers;
• subscriptions;
• professional services;
• premium features.

The features and limitations of each tier will be shown on the platform itself.

KonnektWerk may modify these tiers at any time.

Published prices will include the information legally required.

Where applicable, the relevant VAT will be shown.

The user will know the total amount before confirming payment.

PropCheck's prices (sign-up, listing plans, extra users and featured listings) are published at localcheck.info/propcheck/precios and are governed by these same terms.

Payments will be made through secure third-party payment platforms, such as Stripe or equivalent providers.

KonnektWerk does not store complete bank card details.

Transactions will be subject to the terms of the relevant payment provider.

Any subscriptions will renew in accordance with the terms indicated during the contracting process.

The user may cancel automatic renewal from their private area before the next billing period.

Cancellation will prevent future renewals but will not entitle the user to a refund of amounts corresponding to periods already begun, unless a legal obligation states otherwise.

Where consumer-protection regulations apply, the customer will have the right of withdrawal provided for under applicable law.

However, this right may be lost where performance of the digital service has begun with the user's express consent and the user has acknowledged this circumstance, in accordance with applicable regulations.

The user agrees to use LocalCheck lawfully and in good faith.

The following is prohibited:

• using the platform for unlawful purposes;
• manipulating the results;
• accessing internal systems without authorisation;
• carrying out reverse engineering;
• using robots or automated systems for mass data extraction;
• interfering with the operation of the service;
• infringing the rights of third parties.

LocalCheck may use Artificial Intelligence systems to help interpret regulations, classify information, generate explanations or assist the user.

AI is a support tool.

Automatically generated responses may contain errors, omissions or incomplete interpretations.

The user accepts that no AI-generated response replaces the professional judgement of a competent expert or the corresponding administrative decision.

LocalCheck reuses information from public bodies and official sources.

Updating these sources is the sole responsibility of their respective owners.

In the event of any discrepancy between the information shown by LocalCheck and that officially published by the competent Administration, the latter will always prevail.

KonnektWerk Tech & Entertainment S.L.U. does not guarantee that:

• all information is permanently up to date;
• public sources are free of errors;
• regulations have not been amended;
• the result obtained is sufficient to start an activity.

The user acknowledges that any economic, business, contractual or asset-related decision made on the basis of the information obtained will be their sole responsibility.

KonnektWerk will not be liable for indirect damages, loss of profit, loss of business opportunities or losses arising from decisions made solely on the basis of the information provided by the platform.

KonnektWerk will endeavour to keep the service continuously available.

However, it may temporarily suspend access for reasons of maintenance, upgrades, security, force majeure or technical incidents.

Uninterrupted availability of the service is not guaranteed.

All elements that make up LocalCheck and PropCheck, including software, design, proprietary databases, algorithms, logos, images, text and trademarks (LocalCheck and PropCheck), are owned by KonnektWerk Tech & Entertainment S.L.U. or used under the corresponding licence.

Their reproduction, distribution, transformation, reverse engineering or exploitation without prior written authorisation is prohibited.

Personal data will be processed in accordance with Regulation (EU) 2016/679 (GDPR), Organic Law 3/2018 (LOPDGDD) and LocalCheck's Privacy Policy.

The use of cookies is governed by the corresponding Cookie Policy.

KonnektWerk may amend these Terms and Conditions at any time to adapt them to legal, technical or business changes.

Amendments will be published on the platform and will take effect from their date of publication.

Where amendments substantially affect the rights of registered users, they will be informed by reasonable means.

KonnektWerk may suspend or cancel accounts in the event of fraudulent, unlawful, abusive use or use contrary to these terms, as well as where necessary to protect the security of the platform or comply with a legal obligation.

These Terms are governed by Spanish law.

Any dispute arising in connection with the interpretation or performance of these Terms will be submitted to the Courts of Barcelona, unless a mandatory rule establishes another jurisdiction, particularly in consumer matters.
