In compliance with Regulation (EU) 2016/679 (General Data Protection Regulation, GDPR) and Spanish Organic Law 3/2018 on the Protection of Personal Data and the guarantee of digital rights (LOPDGDD), the user is informed that the controller responsible for processing their personal data is:

Personal data provided by users will be processed for the following purposes, for both LocalCheck and PropCheck (the same account and the same data serve both services):

• Managing the registration and maintenance of the user account.
• Enabling access to LocalCheck's and PropCheck's features.
• Managing queries about properties, premises, offices or warehouses, homes, land or buildings.
• Producing indicative reports and checks on urban-planning feasibility or property due diligence.
• Managing free and paid subscriptions.
• Processing payments and issuing invoices.
• Handling queries and support requests.
• Sending alerts expressly requested by the user.
• Improving the platform's operation and security.
• Detecting fraudulent or abusive use.
• Complying with legal and tax obligations.

Advertising will never be sent by email without the user's prior consent.

Depending on how the platform is used, LocalCheck may process the following categories of data:

Identification data

LocalCheck does not store complete bank card details. Payments are handled by specialised providers that comply with the PCI DSS standard.

Data processing is based on one or more of the following legal grounds:

• Performance of the contract arising from the user's registration.
• Consent of the data subject.
• Compliance with legal obligations.
• Legitimate interest in ensuring the security of the platform, preventing fraud and improving the service.

Personal data will be retained for the following periods:

• Account and profile (entrepreneur, agency or professional): for as long as the account is active. After deactivation, data is blocked and remains available only to judges, courts and authorities for the periods indicated below.
• Report purchases and billing: 6 years from the last accounting entry, under article 30 of the Commercial Code, and 4 years for tax purposes, under article 66 of the General Tax Law.
• Confirmation of consent to immediate delivery of the report (waiver of the right of withdrawal): together with the purchase it relates to and for the same periods, as it is the proof that it was given.
• Agency publication agreement: 5 years from its termination, under article 1964.2 of the Civil Code.
• Listings and their content: for as long as they are published and the account is active. Listings expire automatically under the Terms.
• Contact requests about a listing: for as long as the advertising agency's account is active, to provide support and prevent fraud.
• Transactional and support emails: for as long as necessary to handle the query and, afterwards, until any potential liability lapses.

Once these periods have ended, the data will be securely deleted or anonymised.

Data may only be disclosed when necessary to provide the service or where there is a legal obligation to do so.

These are the data processors used by LocalCheck and PropCheck and what each of them receives:

• Supabase — database and authentication (account, listings, purchases). Hosted in the European Union (Frankfurt).
• Vercel Inc. — portal hosting and technical logs (IP address, user agent).
• Railway — hosting of the urban-planning analysis engine, which receives the address queried.
• Stripe Payments Europe, Ltd. — payment for the report and subscriptions. Your card details are processed directly by Stripe: LocalCheck never sees or stores them.
• Resend — sending of transactional emails (purchase confirmation, account notices).
• Anthropic PBC — drafting of the human-readable layer of the full report and of dynamic translations. See section 8.
• PostHog Inc. — portal usage analytics (pages visited, referral source, elements clicked), only if you accept analytics cookies. Stored in the European Union (Germany). Does not receive the address you query or your name or email.

All of them act as data processors under article 28 of the GDPR and will only process data following the controller's instructions.

As a general rule, personal data is stored within the European Economic Area.

Vercel Inc., Railway, Resend, Anthropic PBC and PostHog Inc. are companies established in the United States, so their involvement entails an international transfer. This takes place under the European Commission's Standard Contractual Clauses and, where the provider has certified, the EU-US Data Privacy Framework, in accordance with the data-processing agreements signed with each one.

Should any other technology provider entail an international data transfer, it will only take place where adequate safeguards exist under articles 44 et seq. of the GDPR, including, where applicable, the Standard Contractual Clauses approved by the European Commission or other legally valid mechanisms.

LocalCheck incorporates features based on Artificial Intelligence to make it easier to interpret public information and to improve the user experience.

Responses generated by these systems:

• are provided as an aid;
• may contain errors;
• do not constitute legal or technical advice;
• do not replace the judgement of a competent professional;
• and do not produce automated decisions with legal effects on the user.

Final decisions on licences, authorisations or urban-planning compatibility rest exclusively with the competent Administration.

What is sent, and what isn't. The provider of these models is Anthropic PBC (United States), which acts as a data processor. Only the minimum necessary to draft the text is sent to it:

• Feasibility report: the activity queried, the neighbourhood and district, the verdict and the warnings. The exact address, your name and your email address are never sent.
• Translation of notices and conditions: the regulatory text to be translated, with no data about the person making the query.
• Assistant for subscribed professionals: in this tool, the address and cadastral reference of the property the professional is analysing are sent, as they are the subject of their query.
• Vera (PropCheck's virtual advisor): the verified address and the facts already obtained (area, urban-planning classification, cadastre, surroundings) are sent so she can answer about that specific property. Your name and email address are not sent.

The data sent is not used to train models, in accordance with the provider's commercial terms.

The user may exercise the following rights at any time:

• Right of access.
• Right of rectification.
• Right of erasure.
• Right to object.
• Right to restriction of processing.
• Right to data portability.
• Right to withdraw consent.

The requester's identity must be verified where legally required.

If the user believes that the processing of their personal data breaches applicable regulations, they may file a complaint with the Spanish Data Protection Agency (AEPD), without prejudice to any other administrative or judicial remedy they see fit.

KonnektWerk Tech & Entertainment S.L.U. applies appropriate technical and organisational measures to protect personal data against:

• unauthorised access;
• accidental loss;
• alteration;
• destruction;
• improper disclosure.

However, the user acknowledges that no security system is completely invulnerable.

LocalCheck's services are not aimed at anyone under 18.

Personal data from minors is not knowingly collected. If the controller becomes aware that data has been obtained from a minor without the corresponding legitimation, it will be deleted without delay.

The user guarantees that the data provided is true, accurate and up to date.

The user also undertakes to report any change to this data.

The user will be liable for any damages arising from providing false or inaccurate data, or data belonging to third parties without authorisation.

The platform may contain links to third-party websites or services.

KonnektWerk Tech & Entertainment S.L.U. is not responsible for the privacy policies, content or data processing carried out by these third parties, and therefore recommends reviewing their respective policies before providing personal information.

KonnektWerk Tech & Entertainment S.L.U. may amend this Privacy Policy to adapt it to regulatory, technical or functional changes.
