Listing terms — Invited agency (v1.1)

Language of these terms

This is an English translation of the Spanish original. The contract is entered into with a Spanish company and is governed by Spanish law; in case of any discrepancy between the two versions, the Spanish version prevails.

1. What this registration is, and what it is not

These terms govern the Invited Agencies Programme of LocalCheck and PropCheck: a free trial period, by personal invitation, under which a real-estate agency (the “Agency”) may list, at no cost for twelve months, commercial units, offices and industrial buildings — including warehouses and storage units — on LocalCheck (the “LON Properties”), and homes, plots or land, and other properties such as buildings, garages or storage rooms on PropCheck (the “PropCheck Properties”). A single registration gives access to both.

What it is for: for the Agency to try the platform with its own portfolio, see whether it is useful and make an informed decision about whether to continue.

What it is NOT: it is not a brokerage, representation or exclusivity agreement, nor an employment or partnership relationship. It does not make KonnektWerk Tech & Entertainment S.L.U. the owner, landlord, seller, agent or representative of the Agency or of any third party, and it does not authorise the Agency to contract or undertake obligations on behalf of LocalCheck.

LocalCheck is a technology provider: it takes no part in the sale, lease or negotiation of the listed Properties, earns no commission on the transactions the Agency closes and guarantees no commercial result.

2. Why this offer differs from open registration

LocalCheck offers an agency two ways to register, and they cannot be combined:

  • Open registration (through the website or a campaign): governed by the Listing Agreement for Real-Estate Agencies, with the launch promotion in force at the time and a twelve-month commitment.
  • Registration by invitation (these terms): twelve full months at no cost, with no setup fee and no minimum commitment, reserved for agencies that LocalCheck contacts personally and to which it gives a personal code.

When the invitation period ends, an Agency that wishes to continue takes out the full plan (the setup fee plus the monthly fee then in force). The launch promotion does not apply to it, as that promotion is designed for those who register on their own: the invited Agency has already enjoyed twelve free months, more than that promotion offers.

The invitation code is personal and single-use. The Agency undertakes not to transfer or share it.

3. What it includes and how long it lasts

The period lasts twelve (12) calendar months from approval of the registration. During that period, at no cost:

  • listing of up to fifteen (15) new LON Properties per calendar month on LocalCheck, with no carry-over from one month to the next;
  • listing of up to fifteen (15) new PropCheck Properties per calendar month on PropCheck, also with no carry-over; the two allowances are independent and cannot be added together or exchanged;
  • keeping properties already listed on either platform, whose renewal does not use up the monthly allowance;
  • calculation of the planning/zoning viability of each LON Property listed and its badge on the listing (PropCheck gives no business verdict: it gathers each property's information and cites its source);
  • a dashboard for managing listings and enquiries, shared by LocalCheck and PropCheck;
  • an email notice with the contact details of anyone who requests information about a listing on either platform.

The Agency may buy additional listings beyond the monthly allowance by one-off payment, at the price shown in its dashboard at the time of purchase. That purchase is voluntary, creates no subscription and does not require keeping any payment method on file.

No payment method is requested or stored to join the Programme, and the period does not automatically turn into a paid service.

4. LocalCheck's commitment

During the invitation period, LocalCheck undertakes to:

  • maintain the service on the terms offered, without introducing new charges;
  • calculate planning/zoning viability from official sources, citing the rule each condition comes from;
  • say so honestly when the available information does not allow a verdict, instead of giving an unreliable one;
  • pass on to the Agency, without intermediation or withholding, the contact details of those interested in its listings;
  • give staggered advance notice before the period ends, in accordance with section 9.

LocalCheck provides the service with the diligence required of a technology provider, without guaranteeing uninterrupted availability of the platform or of the official services from which it obtains planning information.

5. The Agency's responsibility for what it lists

The Agency is solely responsible for the content it lists. It represents and warrants that:

  • it is authorised to market each property and holds the instruction or authorisation of its owner;
  • the listing details (address, floor area, price, features and photographs) are true and up to date;
  • it holds the necessary rights to the images and texts it uploads;
  • it complies with the rules applicable to its business, including, where relevant, registration in the real-estate agents' register of its autonomous community (or, outside Spain, the licence or registration required by the applicable state or local law) and consumer-information obligations.

The Agency shall hold KonnektWerk Tech & Entertainment S.L.U. harmless against any third-party claim arising from the content it has listed.

The planning/zoning viability verdict is preliminary technical information, not a report signed by a qualified professional nor a licence. It does not replace the project or the certification the local authority requires, nor the architect or engineer who must sign them. The Agency shall not present it to third parties as such nor use it in its advertising as a guarantee of a licence.

6. Confidentiality

Both parties shall keep confidential any non-public information they access in the course of this relationship: the Programme's financial terms, the platform's internal workings, portfolio data, usage metrics and any information marked as confidential.

This obligation survives for two (2) years after the relationship ends, and does not cover information that was already public, that the receiving party already knew without a duty of confidentiality, or whose disclosure is required by a competent authority.

LocalCheck may state publicly that the Agency lists on the platform, and use its trade name and logo for that purpose, only if the Agency authorises it in writing. Silence is not authorisation.

7. Data protection

LocalCheck does not sell or transfer to third parties the personal data of the Agency, its contact persons or those interested in its listings. That data is not traded or used for third-party advertising.

Data is processed solely to provide the service: registering and verifying the account, publishing listings, calculating their viability, putting the interested person in contact with the Agency and complying with applicable legal and accounting obligations.

The technology providers involved (hosting, database, transactional email and payments) act as data processors, under a signed contract and without authorisation to use the data for their own purposes. Details are in the Privacy Policy.

Data of interested persons. When someone requests information about a listing, LocalCheck passes their email and phone number to the Agency. From that moment the Agency is the controller of that data: it undertakes to use it only to handle that request, to inform the interested person in accordance with the GDPR, not to transfer it to third parties and not to use it in unrelated marketing without a legal basis. Each party is responsible for its own processing.

The Agency shall appoint a contact point for any security incident affecting that data and notify LocalCheck without undue delay.

8. Proper use of the platform

The Agency undertakes to list each property on the channel that matches its type, and only those types: on LocalCheck, commercial units, offices and industrial buildings (including warehouses and storage units); on PropCheck, homes, plots or land, and other properties such as buildings, garages or storage rooms. It further undertakes not to duplicate listings, not to list properties it does not market and not to use the platform for purposes other than those intended.

Accounts are personal and non-transferable. The Agency is responsible for safeguarding its staff's credentials and for keeping active the two-factor authentication the platform requires for accounts that publish listings.

LocalCheck may remove any listing that breaches the above or that is the subject of a well-founded report, stating the reason.

This registration grants no territorial exclusivity, no preference in search results and no right to feature listings.

9. End of the period, continuation and termination

LocalCheck will notify the Agency by email before the period ends, with staggered reminders over the final months, so that the date comes as no surprise.

When the twelve months are up, the Agency decides:

  • If the Programme has been useful, it may take out the agency plan then in force — setup fee plus monthly fee — whose terms and price will be communicated in advance and which will be governed by the Listing Agreement for Real-Estate Agencies. Signing up is always an express act: there is no automatic renewal or charge.
  • If it prefers not to continue, it need do nothing. The Programme ends at no cost, with no penalty and no minimum commitment.

If the Agency does not take out the plan, it will no longer be able to list new properties. Listings still published will remain visible for thirty (30) calendar days after the end of the period, after which they will be unpublished and deleted together with their photographs.

The Agency may terminate at any time by writing to contacto@localcheck.info and request erasure of its data in accordance with the Privacy Policy. LocalCheck will keep only what tax or evidentiary rules require it to keep.

LocalCheck may suspend or cancel the registration, stating the reason, in the event of a serious breach of these terms or fraudulent use of the platform.

10. A relationship built to last, and general terms

This Programme was created to build a stable relationship. LocalCheck is looking for agencies that want to grow with the platform in their city, which is why the period is long, free and without a minimum commitment: continuation must be earned through proven usefulness, not through a clause.

LocalCheck may amend these terms for technical, legal or operational reasons, giving at least thirty (30) days' notice. If the Agency does not agree, it may terminate at no cost before the changes take effect.

These terms are governed by Spanish law and are supplemented by LocalCheck's Legal Notice, Privacy Policy, Cookie Policy and Terms and Conditions, which the Agency declares it knows and accepts.
